Terms of Service

Effective Date: September 8, 2026

By accessing or using foreignerds.com (the “Site”) or engaging Foreignerds (“Foreignerds,” “we,” “our,” or “us”) for services, you agree to be bound by these Terms of Service (“Terms”). If you do not agree, please do not use the Site or our services.

Foreignerds provides AI development, custom software development, and digital marketing services, including but not limited to:

• AI agent, chatbot, and LLM development; AI integration and predictive analytics
• Custom software, web, mobile, and SaaS development
• SEO, Generative Engine Optimization (GEO), Answer Engine Optimization (AEO), PPC management, and content marketing

These Terms govern your use of the Site itself. Specific project engagements are governed by a separately executed Master Service Agreement, Statement of Work, or proposal (“Project Agreement”), which takes precedence over these Terms in the event of conflict.

You agree to use the Site only for lawful purposes and not to: (a) attempt to gain unauthorized access to our systems; (b) interfere with the Site’s normal operation; (c) scrape, harvest, or reproduce Site content without permission; or (d) misrepresent your identity or affiliation when submitting inquiries.

Foreignerds provides services based on proven methodologies and current industry practice, but outcomes depend on factors outside our control, including third-party platform policies (Google, Meta, LinkedIn, and others), market conditions, competition, and client responsiveness. Accordingly, we do not guarantee specific results, including but not limited to:

• Search engine rankings, AI citation/recommendation frequency, or “AI visibility” outcomes
• Traffic, lead volume, conversion rates, or revenue
• Specific AI model accuracy, uptime, or performance benchmarks for custom-built systems, beyond what is expressly warranted in a Project Agreement

Case studies, portfolio results, and testimonials referenced on the Site reflect specific past engagements and do not guarantee similar outcomes for your business.

5.1 Site Content

All content on the Site — including text, graphics, logos, and design — is owned by or licensed to Foreignerds and protected by applicable intellectual property laws. You may not reproduce or redistribute Site content without our prior written consent.

5.2 Client Deliverables

Ownership of deliverables produced under a specific Project Agreement (custom code, creative assets, campaign materials, etc.) is governed by that Project Agreement. In the absence of a specific provision, and upon full payment, Foreignerds assigns to the client ownership of custom deliverables created specifically for that client, excluding Foreignerds’ pre-existing tools, frameworks, and know-how, which remain our property and may be reused across engagements.

Fees, invoicing schedules, and payment terms for specific engagements are set out in the applicable Project Agreement. Late payments may result in suspension of services and are subject to the terms specified in that agreement.

Each party agrees to protect the other’s confidential information disclosed during the engagement and to use it only for purposes of the engagement. This obligation survives termination of the relationship. Foreignerds may reference a completed engagement in its portfolio or marketing materials in general terms, unless the client requests otherwise in writing.

• Where we build AI systems for a client, that client’s data is processed under the terms of the Project Agreement, not for training external or public AI models.
• We may recommend or implement third-party tools and platforms (advertising networks, CRMs, hosting providers, AI infrastructure providers) on a client’s behalf. We are not responsible for those third parties’ policies, pricing, availability, or changes to their platforms.
• Clients retain ownership of any third-party accounts created on their behalf during an engagement.

TO THE FULLEST EXTENT PERMITTED BY LAW, FOREIGNERDS SHALL NOT BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING LOSS OF PROFITS, REVENUE, DATA, OR GOODWILL, ARISING FROM YOUR USE OF THE SITE OR OUR SERVICES, EVEN IF ADVISED OF THE POSSIBILITY OF SUCH DAMAGES. Our total liability for any claim arising from the Site (as distinct from a specific Project Agreement, which may set its own liability terms) shall not exceed $10 USD.

You agree to indemnify and hold Foreignerds harmless from claims, damages, or expenses (including reasonable attorneys’ fees) arising from your misuse of the Site, violation of these Terms, or infringement of any third-party right.

We may suspend or terminate your access to the Site at our discretion, without notice, for conduct that violates these Terms. Termination of a specific client engagement is governed by the applicable Project Agreement.

The Site may link to third-party websites for reference or convenience. We do not control and are not responsible for the content or practices of those sites.

These Terms are governed by the laws of the State of Delaware, without regard to conflict-of-law principles. Any dispute arising under these Terms shall be resolved in the state or federal courts located in Delaware, and you consent to the personal jurisdiction of those courts.

We may revise these Terms from time to time. The “Effective Date” at the top reflects the most recent revision. Continued use of the Site after changes constitutes acceptance of the revised Terms.
